1. Acceptance of Terms
By accessing or using Assure Signing Services’ website, scheduling an appointment, or receiving notary, loan signing, or related services, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use our services.
These Terms apply to all clients, signers, and users (“you,” “your”) who engage with our notary or signing services, whether in-person, mobile, or remote (online notarization).
2. Description of Services
Assure Signing Services provides:
General Notary Services (acknowledgments, jurats, oaths, affirmations, etc.)
Loan Signing Services for real estate transactions
Remote Online Notarization (RON)
Mobile Notary Services within New York State
We are not attorneys and cannot provide legal or financial advice. Our services are limited to verifying identity and witnessing the signing of documents as authorized under New York State law.
3. Client Responsibilities
You agree to:
Present a valid, government-issued photo ID at the time of notarization.
Ensure that all documents are complete and unsigned prior to the notarization.
Appear in person or through a state-approved remote platform if applicable.
Confirm that you understand and are signing voluntarily.
Failure to meet these requirements may result in refusal of service.
4. Scheduling, Fees, and Payments
All fees are based on New York State guidelines and service type.
Travel or convenience fees may apply for mobile appointments.
Remote notarization fees will include platform or technology charges.
Payment is due at the time of service unless otherwise arranged.
Cancellations must be made at least 24 hours in advance to avoid a cancellation fee.
5. Electronic and Remote Notarization
For RON services, you agree to:
Participate through a New York–approved RON platform (e.g., BlueNotary, Notarize, etc.).
Undergo identity verification, which may include credential analysis, knowledge-based authentication (KBA), or biometric verification.
Allow your session to be recorded and stored securely in compliance with state requirements.
Recordings and electronic journals are kept for the period required by State law and remain the property of Assure Signing Services.
6. No Legal Advice
Assure Signing Services and its notaries are not attorneys licensed to practice law.
We do not:
Interpret documents
Advise on legality, content, or enforceability
Prepare legal documents (unless directed by an attorney or authorized by law)
If you require legal guidance, we recommend consulting a licensed attorney before your appointment.
7. Privacy & Data Protection
We respect your privacy. Any personal or identifying information collected during the notary process (including IDs, documents, or biometric data) is used solely for identity verification and recordkeeping in compliance with state law.
We do not sell or share client information with third parties except as required by law or authorized platforms.
8. Limitations of Liability
Assure Signing Services is not responsible for:
Delays caused by incomplete documents, technology issues, or third-party platforms
Legal outcomes resulting from the contents of your documents
Any damages, claims, or losses beyond the cost of the notary service provided
Our total liability shall not exceed the amount paid for the specific notarial act in question.
9. Refusal of Service
We reserve the right to refuse or discontinue service if:
The signer appears unwilling, unaware, or unable to sign knowingly
The document is incomplete, contains blank spaces, or appears fraudulent
Proper identification cannot be provided
10. Changes to Terms
We may update these Terms at any time. Updated Terms will be posted on our website with a revised effective date. Continued use of our services after any changes constitutes acceptance of those changes.
11. Governing Law
These Terms are governed by the laws of the State of New York.
Any disputes arising from or relating to these Terms shall be resolved in the courts located within Dutchess County, New York, unless otherwise required by law.
